Terms of service

Who can order

You need to be 18 or older to place an order with me, and you’ll need a valid payment method. Ordering as a gift or for someone else is fine — just make sure you have authority to use the payment method.

Orders and pricing

Everything on therushtonedit.com is priced in US dollars. I do my best to keep listings accurate, but availability can change, and now and then a price gets listed wrong. If that happens, I’ll contact you before charging you anything, and you can cancel if the corrected price doesn’t work.

Changed your mind right after ordering? Email me within 48 hours and I’ll try to accommodate a change or cancellation — I can’t guarantee it once a print is already underway.

Your order isn’t a binding contract the moment you place it. It becomes one when I confirm dispatch — not before. That gives both of us room to sort out a pricing error or an unavailable item without either side being locked in.

Sales tax is collected where required by law. For orders shipped within Texas, that’s 8.25% in Austin (state plus local), applied to the full charge including shipping.

Limited editions

When I list a print as a limited edition, the number on the listing is a hard cap — I will not print more of that image at that size once the edition sells out. Each print is numbered, and I hold back 2 artist’s proofs per edition that aren’t sold as part of the numbered run. Every numbered print comes with a signed certificate of authenticity.

Copyright and use

Buying a print means you own that physical object — you don’t own the image. I keep copyright to every photograph I sell. A print is for personal display only. You may not reproduce, scan, photograph, publish, or otherwise copy the image for any purpose, commercial or not, without my written permission. Want to license an image for something else? Email rushton@therushtonedit.com.

Screen vs. print

Every screen renders colour a little differently, and a photograph on a monitor will never look exactly like the same image on paper. I calibrate carefully, but small colour differences between what you see online and what arrives are normal, not a defect.

Handmade goods

Candles and other handmade items are made in small batches by hand, not on a production line. Expect small, natural variation between one candle and the next — in colour, scent throw, or finish. Always follow the safety label on the vessel; see my candle safety page for the full statement.

Services

Real estate and drone photography sessions are booked in advance and held with a deposit. Cancellation and weather terms are set out in your services agreement, sent at booking — in short, I ask for notice, and I reschedule for weather at no charge. Deliverables and turnaround times are also spelled out there.

When you book a shoot, I grant you and your brokerage a licence to use the images to market that property. I keep copyright and don’t sell or transfer the images to anyone else. Drone flights are subject to FAA Part 107 and any airspace authorisation the location requires — I may decline or reschedule a flight for safety or legal reasons. My liability for a services booking is limited to the fee you paid for that session.

Payment methods

I accept the payment methods offered at checkout, including Shop Pay and any instalment options Shopify provides. Those have their own terms, set by the provider, not me.

Governing law

These terms, and anything arising from a purchase through therushtonedit.com, are governed by the laws of the State of Texas.
